The anonymous Life of King Edward, written about the time of the Norman Conquest, is an important and intriguing source for the history of Anglo-Saxon England in the years just before 1066. It provides a fascinating account of Edward the Confessor and his family: his wife Edith, his father-in-law Earl Godwin, and the queen's brothers Tostig and Harold. The foundations of the legend of St Edward the Confessor are apparent from the version of the work supplied by (...) the unique MS of c.1100. Professor Barlow explores the problems raised by this anonymous work in its now incomplete MS, and examines the development of the cult of St Edward. He also investigates the life and works of Folcard and Goscelin of St Bertin, possible authors. Recent discoveries have enabled Professor Barlow to reconstruct in part the lacunae in BL Harley MS 526 with texts closer to the original. For the second edition, he has undertaken a complete revision of the book. (shrink)

According to the preference-centric approach to understanding partial belief, the connection between partial beliefs and preferences is key to understanding what partial beliefs are and how they’re measured. As Ramsey put it, the ‘degree of a belief is a causal property of it, which we can express vaguely as the extent to which we are prepared to act on it’ The Foundations of Mathematics and Other Logical Essays, Routledge, Oxon, pp 156–198, 1931). But this idea is not as popular as (...) it once was. Nowadays, the preference-centric approach is frequently dismissed out-of-hand as behaviouristic, unpalatably anti-realist, and/or prone to devastating counterexamples. Cases like Eriksson and Hájek’s :183–213, 2007) preferenceless Zen monk and Christensen’s :356–376, 2001) other roles argument have suggested to many that any account of partial belief that ties them too closely to preferences is irretrievably flawed. In this paper I provide a defence of preference-centric accounts of partial belief. (shrink)

Aesthetics is regarded, traditionally, as an aspect of philosophy. Arthur Edwards' approach is different. Ignoring philosophy, he points out that any work of art is devised in the mind of the artist and interpreted through the mind of the beholder and the object must therefore constitute a device of communication between these two minds. In this agreeably written, fully illustrated and constantly fascinating study he explores the implications of this idea, remembering that both artist and experiencer may be of any (...) culture. (We can respond, granted a degree of familiarity, to works produced by artists from cultures as different from our own as those of a Palaeolithic cave man, an Aztec priest, a West African wood-carver or a medieval monk.) The result is an astonishingly wide-ranging quest, one which extends from an investigation of communication theory to an account of the ecological concepts held by certain Amazonian tribes, from a demolition of Freud's model of the psyche to a study of the trigonometry of the Great Pyramid and from an account of the evolution of the human mind to a theory, albeit partial, concerning the nature of beauty. All are held within two complementary themes: the relevance to his enquiry of Jungs theory of the collective unconscious together with the archetypes of which it is composed, and the confirmation of these concepts by independent evidence. Augustine of Hippo was a fourth- and fifth-century monk-bishop who left a great imprint on the spiritual leaders of his day by overseeing the monastery at Hippo Regius and also authoring a significant corpus of letters that were pastoral in nature. What is often overlooked in the study of his pastoral ministry and, thus, the focus of this article, is Augustine’s theological correspondence with 15 different women. Through surveying the themes and issues in these letters, I have endeavoured to (...) show that, though a monk, Augustine did care for women in his pastoral ministry and his letters show that he discussed with women many of the issues of his day that he also discussed with his male correspondents. In short, Augustine believed that these women were much like his mother Monica – capable of grasping biblical and theological issues – and he valued them as an important part of the church. I conclude the article by summarising Augustine’s approaches to and values for ministering to women. (shrink)

This article uses the two prose Lives of Cuthbert written by an anonymous monk of Lindisfarne and by Bede in the first half of the eighth century to illustrate how an understanding of the impact of biblical language and its accompanying exegetical tradition may help in the interpretation of hagiographical works. After an examination of recent scholarly work on the relationship scripture and hagiography and the impact of signa upon the early medieval thought‐world, the paper examines the incidents (...) that are recorded as happening during Cuthbert's time as a hermit on Farne. Looking first at the Lindisfarne account, the potential symbolism inherent in miracles concerning building materials such as rock, stone and wood, as well as living water and ravens are examined by outlining biblical parallels and then looking at the development of the symbols in the exegetical tradition. It thus becomes apparent that the writer was using a shared Christian symbolic language to make statements about Cuthbert as builder of the Northumbrian Church. A similar process is undertaken with Bede's account, noting differences and additions, and reaching the conclusion that it is more developed, showing Cuthbert as a teacher and pastor. In both cases the writers were using the events to foreshadow Cuthbert's imminent episcopal career, thus connecting the contemplative preparation with the subsequent active ministry. The article concludes that the hagiographers believed that God continued to speak to His Church through signa as He had spoken in the Bible and that it was natural His words should coincide with their own polemical and didactic concerns and intentions. In this article the authors discuss the decision of the House of Lords in Adam, Limbuela and Tesema, where the judges gave detailed scrutiny to the support duty s.55 of the Nationality, Immigration and Asylum Act 2002 towards those who are seeking asylum and considered the approach to be adopted in determining whether there was an incompatibility with Art.3 of the European Convention on Human Rights if support was denied.

We examine the compromises that are actually made in modern scientific discourse concerning atoms. We conclude that even the ideals of clarity and consistency can be legitimately compromised in order to obtain other advantages.

Seeking to rediscover the connection between philosophy as studied in universities and those general views of man and reality which are 'philosophy' to the educated layman, Edward Craig here offers a view of philosophy and its history since the early seventeenth century. He presents this period as concerned primarily with just two visions of the essential nature of man. One portrays human beings as made in the image of God, required to resemble him as far as lies in our (...) power; the other sees us as autonomous creators of our own environment and values. The author writes with a broad sweep not encouraged by recent fashion, yet shows how textual detail which previous commentators have found opaque becomes transparent when viewed against such a background. In the final chapter he treats passages from recent work in the same way. The general conceptions which philosophical thought embodies can equally well be embodied in other media, especially literary. The author illustrates this point with German and English examples and thereby draws together disciplines often felt to be far apart. He also reveals striking similarities between Anglo-American and certain twentieth-century continental European lines of thought. (shrink)

Abstract:The purpose of this paper is to suggest that at least one strain of what has come to be called “stakeholder theory” has roots that are deeply libertarian. We begin by explicating both “stakeholder theory” and “libertarian arguments.” We show how there are libertarian arguments for both instrumental and normative stakeholder theory, and we construct a version of capitalism, called “stakeholder capitalism,” that builds on these libertarian ideas. We argue throughout that strong notions of “freedom” and “voluntary action” are the (...) best possible underpinnings for stakeholder theory, and in doing so, seek to return “stakeholder theory” to its managerial and libertarian roots found in Freeman (1984). The arguments of the dialetheists for the rejection of the traditional law of noncontradiction are not yet conclusive. The reason is that the arguments that they have developed against this law uniformly fail to consider the logic of encoding as an analytic method that can resolve apparent contradictions. In this paper, we use Priest [1995] and [1987] as sample texts to illustrate this claim. In [1995], Priest examines certain crucial problems in the history of philosophy from the point of view (...) of someone without a prejudice in favor of classical logic. For each of these problems, the logic of encoding offers an alternative explanation of the phenomena---this alternative is not considered when Priest describes what options there are in classical logic for analyzing the problem at hand. -/- The argument at heart of the case that Priest develops against the law of noncontradiction (i.e., the argument based on the paradoxes of self-reference) is then reanalyzed in light of encoding logic. After showing why the argument is inconclusive, the paper concludes both with a more general discussion of logic and predication and with the suggestion that there is no need to tamper with the logic of the traditional mode of predication if there is alternative mode of predication which is well-suited to the analysis of cases involving contradictory objects. In this study, we propose and test a model of the effects of organizational ethical culture and organizational architecture on the perceived unethical behavior of employees towards customers. This study also examines the relationship between organizational ethical culture and moral acceptability judgment, hypothesizing that moral acceptability judgment is an important stage in the ethical decision-making process. Based on a field study in one of the largest financial institutions in Europe, we found that organizational ethical culture was significantly related to the (...) perceived frequency of unethical behavior towards customers and to the moral acceptability judgment of this type of unethical behavior. No support was found for the claim that features of organizational architecture are associated with the perceived frequency of unethical behavior towards customers. This is the first study to document the differential effects of organizational architecture and organizational ethical culture on perceived unethical behavior of employees towards customers, in wholesale banking. Implications for managers and future research are discussed. (shrink)

The following paper investigates the possibility of an account of cosmopolitan thought inspired by Hegel's treatment of Kant's ethical theory and his associated social concept of recognition. Cosmopolitanism requires the agent to recognize themself as a global agent participating in a shared community, but conventional political strategies do not possess the resources to satisfy this demand for self-understanding. Such a self-understanding is enabled by the objective freedom of a common shared humanity grounded in rational self-determination. Family carers of individual’s living with Huntington’s Disease (HD) manage a distinct and unique series of difficulties arising from the complex nature of HD. This paper presents the validation of the definitive measure of quality of life for this group. The Huntington’s Disease Quality of Life Battery for carers (HDQoL-C) was expanded and then administered to an international sample of 1716 partners and family carers from 13 countries. In terms of the psychometric properties of the tool, exploratory analysis of half (...) of the sample, demonstrated good internal consistency and reliability. Some items on the full version did not meet psychometric thresholds and a short version (HDQoL-Cs) was developed based on more stringent criteria. Confirmatory Factor Analysis of the model structure showed a good fit for all Factors and, indicated that the HDQoL-C and HDQoL-Cs are psychometrically robust measures of quality of life. We found that carers who lived with and looked after their spouse/partner had reduced sense of coping, hope for the future and overall quality of life. Carers with children who were at risk, carried the gene or were symptomatic also had poorer quality of life outcomes. Findings indicated the HDQoL-C and HDQoL-Cs are valid in multiple languages and across varied cultures as measures of self-reported quality of life in family carers of individual’s living with HD. These psychometrically validated tools can aid and guide the implementation of therapeutic interventions to improve life quality in this population. (shrink)

This paper introduces a new typology and associated measure of social and environmental mission integration by conceptually framing a feature of hybrid organizations—the degree of integration of their revenue model and social–environmental mission. The SEMI measure is illustrated using a hand-collected sample of 256 North American Certified B Corporations. We explore the heterogeneity of SEMI scores by identifying external-facing correlates and demonstrate non-congruence with Certified B Corporation’s audit results. The purpose of this volume is to help develop, through a variety of exploratory essays, the art and science of institutional design. The authors look at a variety of good societies as artifacts, as products—at least partly—of design, and consider how such societies can be crafted. They identify themselves with the New Constitutionalism movement, which aims to develop and promote the knowledge necessary for institutional reform and institutional creation through understanding the designer's, creator's, founder's, or reformer's perspective. From the author: This dissertation undertakes a critical examination of one central problem in Hegelian philosophy: viz., whether the final realization of “absolute knowledge” is logically consistent with significant epistemic progress in the system’s continuing development. Serious consideration of the concept of systematic completeness, as interpreted on Hegel’s terms, uncovers the existence of a profound paradox. On the one hand, if the Truth is the Whole, then the truth of any finite part or aspect of that Whole depends upon its (...) place within the system as a totality. In order to grasp the part and comprehend it correctly, one must already have a systematically ordered knowledge of the universe in its entirety. Yet the methodological open-endedness of dialectical thinking precludes the acceptance of any particular theoretical formulation as final or complete in itself. Hegel interprets the history of philosophy as a progression of successive formulations of the Truth, each of which improves on its predecessors by reconciling their internal contradictions, but no one of which is adequate in itself. Hence, no theoretical world view, including Hegel’s own, can rest content within its limits, for the inevitable advance of thought must in the end throw it down. (shrink)

In this essay I will assume that all well-developed discussions of the authenticity of responsibility are metaphysical ones. But as I intend to make use of the notion of being at a number of crucial points, I will call responsibility ontic responsibility rather than metaphysical responsibility. If ontic responsibility should be authentic, both social responsibility and its most important particular instance, legal responsibility, will be qualified by it, and we shall not be able to capture their full meaning in terms (...) of de facto accountability. As for moral responsibility, its status will also depend upon whether or not ontic responsibility is authentic. Indeed, many readers might prefer to say that "ontic responsibility" is simply another name for moral responsibility--that the question whether we are so constituted in our ontological natures as to make accountability appropriate, just, and seemly is merely the question whether moral responsibility is authentic. But there are some grounds for thinking that ontic responsibility is a wider category and that, if it is authentic, moral responsibility is a special case of it--ontic responsibility exercised in certain well-defined and very important circumstances. It is clear, for instance, that ontic responsibility covers all acts whatsoever, or at least all acts that admit of degree of excellence, so that all our work in science, in the arts, and indeed in the entire practical-productive sphere comes under it. Thus, all Max Planck's work in science from his 1879 doctoral dissertation to his famous 1900 paper would exemplify it. But most of us would probably say that only some of the ontically responsible acts performed in the course of his scientific work were also instances of moral responsibility--perhaps only those which involved relations with other persons. At any rate, in this essay I will assume that, if ontic responsibility is authentic, moral responsibility is a special case of it. It will be clear, then, that we want the notion of ontic responsibility to function in many of the ways in which the notion of free will functions in other settings. We shall see that there is some advantage in thus avoiding that vexed notion in what follows. (shrink)

There are few models of price competition in a homogeneous-good market which permit general asymmetries of information amongst the sellers. This work studies a price game with discontinuous payoffs in which both costs and market demand are ex ante uncertain. The sellers evaluate uncertain profits with maximin expected utilities exhibiting ambiguity aversion. The buyers in the market are permitted to split between sellers tieing at the minimum price in arbitrary ways which may be deterministic or random. This is a letter written in reply to some criticisms of object theory's analysis of mathematics. The criticisms were offered by Philip Ebert and Marcus Rossberg, in connection with my talk at the 31st International Wittgenstein Symposium, in Kirchberg, 2008. The exchange was published in the volume of proceedings.

In the debate about the nature and identity of possible worlds, philosophers have neglected the parallel questions about the nature and identity of moments of time. These are not questions about the structure of time in general, but rather about the internal structure of each individual time. Times and worlds share the following structural similarities: both are maximal with respect to propositions (at every world and time, either p or p is true, for every p); both are consistent; both are (...) closed (every modal consequence of a proposition true at a world is also true at that world, and every tense-theoretic consequence of a proposition true at a time is also true at that time); just as there is a unique actual world, there is a unique present moment; and just as a proposition is necessarily true iff true at all worlds, a proposition is eternally true iff true at all times. In this paper, I show that a simple extension of my theory of worlds yields a theory of times in which the above structural similarities between the two are consequences. (shrink)

Composite tissue allotransplantation involves the (...) transplantation of any combination of vascularized skin, subcutaneous tissue, blood vessels, nerves, muscle, and bone. Orthotopic hand transplantation is considered the first clinical example of CTA and has seen success at many different centers worldwide. Facial allotransplantation is a recent development in the field of CTA and the first successful case was performed as recently as November 2005. Since then there have been a number of successful facial transplants. The purpose of this paper is to examine some of the issues surrounding facial transplantation including the complex ethical issues, the surgical and clinical issues, cost and administrative issues, and future directions for this new, exciting, and controversial field.Keywords: composite tissue allograft, facial transplantation. Inequality is the defining feature of our times. Many argue that it calls for a policy response, yet the most obvious policy responses require legislative action. And if inequality is the defining feature of our times, partisan acrimony and gridlock are the defining features of the legislature. That being so, it is worth considering what role administrative agencies, and administrative law, might play in ameliorating or exacerbating economic inequality. Here, I focus on American safety net programs, many of which are (...) joint operations between federal administrative agencies and state governments. In this context, a central mode of bureaucratic policy innovation comes in the form of administrative waivers, whereby a federal administrative agency waives some statutory requirement that is otherwise binding on state administrators. For example, the Centers for Medicare and Medicaid Services recently granted waivers to allow several states to impose various “personal responsibility” requirements on Medicaid beneficiaries. Faced with a choice between legislative inactivity and policy innovation through waivers, many scholars and policymakers of both parties have tended to favor waivers. The appeal of waivers as a path around legislative gridlock is compelling. However, I argue that this view has neglected the federal structure of American safety net programs, and does not account for the state politics of implementation. Moreover, scholars have not focused on the severe information problems that federal agencies face when issuing waivers; a permissive waiver regime exacerbates these problems. Focusing on Medicaid implementation, I highlight the risks of waivers for American safety net programs. Before concluding, I discuss possible reforms to administrative procedures, and offer a case study of litigation surrounding one recent waiver application. The case study illustrates many of the theoretical arguments, and further demonstrates the failure of judicial review; it indicates how review might be adjusted to promote more effective use of waivers and diminish their perils. This paper examines the ethics of the Australian business community’s responses to the phenomenon of modern slavery. Engaging a critical discourse approach, we draw upon a data set of submissions by businesses and business representatives to the Australian government’s Joint Standing Committee on Foreign Affairs, Defence and Trade ‘Parliamentary Inquiry into Establishing a Modern Slavery Act in Australia’—which preceded the signing into law of Australia’s Modern Slavery Act 2018—to examine the business community’s discursive construction in their submissions of the ethical–political (...) concept of freedom. The paper shows how the concept of freedom was employed by Australian business in a manner that privileged their own subject status and advocated for legislation with minimal burden. Relating this contemporary case to a longer historical context, we show how Australian business responses towards modern slavery map onto liberal and neoliberal ethics in which the freedom of the propertied takes precedent over that of the property-less. Further, we show discursive similarities in the arguments presented by modern Australian businesses and certain historical efforts by members of the business community to privilege commercial freedoms in responses to 18th and 19th Century abolitionist movements. Overall, our research makes two important contributions: first, it highlights the value of a critical discourse lens in business ethics research to show how business and other stakeholders in the field construct and shape their own and other’s ethically-laden understanding of reality; and second, it presents a case for considerable scepticism about the motivation of business to employ the freedoms made available to it under neo/liberal discourse to confront a key human rights challenge. This special issue presents developments in research on the cognitive mechanisms and consequences of surprise. Amidst much progress, surprise research has often been siloed, so, as editors, we have sought to juxtapose insights, theories, and findings, to support cross‐fertilization in future research. The present paper sets the stage by presenting a historical summary, highlighting contrasts in definitions, and tracing major threads running through this issue and the larger surprise literature.

Thymidylate synthase plays a central role in the biosynthesis of thymidylate, an essential precursor for DNA biosynthesis. In addition to its role in catalysis and cellular metabolism, it is now appreciated that thymidylate synthase functons as an RNA binding protein. Specifically, thymidylate synthase binds with high affinity to its own mRNA, resulting in translational repression. An extensive series of experiments has been performed to elucidate the molecular elements underlying the interaction between thymidylate synthase and its own mRNA. In addition to (...) characterization of the underlying cis‐ and trans‐acting elements, recent studies have shown that thymidylate synthase has the capacity to bind specifically to other cellular RNA species. While the biological significance of these other RNA/thymidylate synthase interactions remains to be defined, this work suggests a potential role for TS in coordinately regulating several critical aspects of cellular metabolism. In this paper, I present a metaphysical solution to the all-or-nothing problem, which rejects the description of the choices in favour of lower-level descriptions.

This article offers suggestions for categorizing combat-related moral injuries, highlights possible causes of these injuries in veterans, and touches upon broadly-conceived measures to prevent and repair them. The first part identifies three prevailing definitions – lost trust, guilt, and harm to one’s capacity for right action and moral virtue – and argues for an emphasis on the latter. In service of highlighting areas for future empirical research and clinical awareness, the second part outlines possible veteran-related causes associated with these three (...) definitions, including unwarranted distrust of authorities, misapplying the theodicy problem to human acts, undue survivor’s guilt, wars that fail to meet ad bellum criteria, causing permissible collateral damage, and killing combatants without regret and for pleasure. The third part mentions strategies for preventing character harm, and then discusses the cognitive, rehabituative, and psychological aspects of moral repair. (shrink)

Must the state handle the adjudication of disputes? Researchers of different perspectives, from heterodox scholars of law who advocate legal pluralism to libertarian economists who advocate the privatization of law, have increasingly questioned the idea that the state is, or should be, the only source of law. Both groups point out that government law has problems and that non-state alternatives exist. This Article discusses some problems with the public judicial system and several for-profit alternatives. Public courts lack both incentives to (...) embrace customer orientation and pricing mechanisms, plus they face problems associated with the bureaucratic provision of services. When parties are able to choose their tribunals, in contrast, those tribunals must provide service to customers and be mindful about conserving resources. Competition between arbitrators also can allow for experimentation and the provision of customized services rather than a centrally planned, one-size-fits-all system. Contracts with arbitration clauses can easily stipulate the choice of tribunal, and we argue that if government courts simply refused to overrule binding arbitration agreements, de facto privatization could easily take place. This Article discusses how the private adjudication of disputes could enable the market to internalize externalities and provide services that customers desire. (shrink)

In this paper, I respond to D. Jacquette's paper, "Mally's Heresy and the Logic of Meinong's Object Theory" (History and Philosophy of Logic, 10 (1989): 1-14), in which it is claimed that Ernst Mally's distinction between two modes of predication, as it is employed in the theory of abstract objects, is reducible to, and analyzable in terms of, a single mode of predication plus the distinction between nuclear and extranuclear properties. The argument against Jacquette's claims consists of counterexamples to his (...) reductions and analyses. Reasons are offered for thinking that no such reduction/analysis of the kind Jacquette proposes could be successful. (shrink)

Considers and rejects two common explanations of the roots of scepticism. The first, that finds them in a first‐person approach to epistemology that takes as its central question ‘what do I know?’, is rejected on the grounds that first‐personalism results from thinking about certain normally ignored possibilities and gives no explanation of why they are so ignored, and therefore no adequate explanation of scepticism. The second, that scepticism is the offspring of an ‘absolute’ conception of truth, is espoused by Bernard (...) Williams and Thomas Nagel. Craig argues that since no explanation is given of why it is impossible in principle to attain the absolute conception, the only way adhering to the idea of such a conception can lead to scepticism is if we raise independently the traditional sceptical possibilities. The principal aim of this chapter is to document and describe the ‘dominant philosophy’ of the seventeenth and early eighteenth centuries: the doctrine that man was made in the image of God. Examining writings by thinkers such as Galileo, Descartes, Pascal, Spinoza, Leibniz, Malebranche, Newton, Clarke, and Berkeley, Craig finds that they were all committed to some version of the Similarity Thesis. Its cognitive branch, the ‘Insight Ideal’, manifests itself in the view that our logical and mathematical knowledge and our (...) knowledge of our own mental states possesses a certainty that even God cannot surpass, as well as in the, then widespread, view that we live in a world that is, in principle, fully intelligible to us. The link between the human and the divine mind is usually thought to be provided by the faculty of reason, but the Similarity Thesis has also taken the form that the human mind is in fact a part of the divine intellect. It connects with the prevalence of a contemplative or scientific ethic in which the pursuit of knowledge appears as a good in itself. Moreover, there is a version of the Image of God doctrine focusing on agency and finding expression in the view of, for example, Descartes that, at its best, the human will is as free as a will could possibly be.
